Introduction

The purpose of this privacy policy (“Privacy Policy”) is to set forth how the Company, (“Company”, “us”, “we”, “our”) or third parties authorised by it, collect, use, and maintain Information (defined below) about you through your access and use of the Application and the Services offered by Company. Capitalised terms not defined herein shall have the same meaning ascribed to them in the Terms of Use available at terms and conditions.

We recognize the importance of your privacy, and we are committed to ensuring that you are aware of how your Information is being used. Please read this Privacy Policy carefully. Your use of the Application and the Services is also governed by our Terms of Use.

This Privacy Policy shall apply to all Information that Company collects in furtherance to your access/use of the Application and/or Services including but not limited to any information you may submit to access the Application and avail the Services in accordance with the Terms or e-mails that you exchange with Company. This information is necessary for the adequate performance of our

obligations towards you and to allow us to comply with our legal obligations. Without this

information, we may not be able to provide you access to and allow the use of the Application and Services.

Company or any third-parties authorised by the Company may collect different types of information, via your use of the Application, which is collectively hereinafter referred to as “Information”. This Information could be of the following types:

1. (i) Account Information: information that you provide while creating an Account or have provided to the Company in the past such as your first and last name, phone number, and e-mail address.
2. (ii) Personally Identifiable Information or PII: information that could be used to identify you such as your name, email address, location, survey number of your farmland, and other similar information.
3. (iii) Non-Personal Information: information that cannot be used to identify you such as photographs, texts, files, videos of the crops grown on your farmland, fertilisers used, soil health, your application usage patterns, and your feedback uploaded on the Application. Other information of similar nature may be collected from you from time to time.
4. (iv) Device Information: information which is automatically collected about the operating system or version of the system from which the Application is used, which includes device ID, location of the device, crash reports, and logs generated by the Application.

You are responsible for ensuring the accuracy of any Information you submit to the Company in furtherance of your use or access to the Application and/or the Services. Inaccurate Information may affect your ability to use the Applications and therein the Services that are provided to you.

You understand that the Information collected by Company, or any third-party authorised by the Company, may be collected directly or through automatic tracking of your usage of the Application through the use of tracking technologies. The data automatically collected may include usage information such as details of your computing and/or communication device location, connections, or any information that Company or any third-party authorised by the Company may collect through the tracking technologies. You may decline the Company's use of these tracking devices by changing your Application settings, if permitted. However, do note that this may impact the Services availed by you.

The Information that we collect from the use and access of the Application and the Services availed will be used for the following purposes:

1. (i) To provide Services;
2. (ii) To make improvement to the Application and the Services;
3. (iii) To provide the relevant Information to Company’s partners, government, and government agencies who have requested for it;
4. (iv) Internal purposes to understand the background of the users of the Application;
5. (v) Correspondence/communicate with you through emails, SMS, WhatsApp (and any other methods of communication determined and notified to you by the Company) pursuant to your use of the Application;
6. (vi) To provide you with information, Services and emails where you have consented to be contacted for such purposes;
7. (vii) To notify you about changes to the Application, this Privacy Policy or the Terms of Use;
8. (viii) To notify you about any change and improvements to the Application and/or Services;
9. (ix) For analytical purposes, including but not limited to assessing usage data, usage patterns and other similar activities to evaluate the Application and/or the Services;
10. (x) In any other manner we may describe when you provide the Information.

Except as otherwise provided herein, no PII will be stored, published, disclosed or shared with any third party without your express consent.

Please do not include or submit any PII unless specifically requested by Company. If Company determines that any Information you have provided or uploaded violates the terms of this Privacy Policy, Company has the right, in its absolute discretion, to delete or destroy such Information without incurring any liability to you.

You agree to your PII being used by us or by any third party authorised by us, in order to contact you and deliver information and any other communication relevant to your use of the Application or availing of Services. If you do not wish to receive these communications, you may at any time inform Company using the e-mail address support@krishitantra.com.

We consider the confidentiality and security of your Information to be of the utmost importance. We will or shall ensure that third parties collecting or accessing or storing or using your Information shall use industry standard physical, technical and administrative security measures to keep your Information confidential and secure and will not share it with third parties, except as otherwise provided in this Privacy Policy, or unless we have a good faith belief that such disclosure is necessary in special cases, such as in compliance with legal/ regulatory requests, to address fraud, security or technical issues or a physical threat to you or other users. By providing any Information to us, you consent to Company or to such third parties authorised by the Company to providing such Information to any governmental, law enforcement or regulatory authorities who exercise jurisdiction over Company or such third party, upon receiving an order to do so under applicable law.

Given the nature of internet transactions, Company or third parties authorised by it under this Privacy Policy, cannot guarantee the security of such Information or take any responsibility for the transmission of Information on the internet because there is some risk that an unauthorized third party may find a way to circumvent its security systems or that transmission of your Information through the Application may be intercepted. Any transmission of Information on the internet is done at your risk and Company or such third party authorised by it under this Privacy Policy, shall not be responsible for the circumvention of the privacy or security settings either by you or any third party.

The Privacy Policy does not apply to, nor does Company take any responsibility for, any information that is collected by any third party either using the Application or providing any related services including but not limited to payment services through an external platform.

We may disclose your Information to our agents, employees, advisors, service providers and affiliates, as well as any other third parties authorised by us who require the Information for the purposes of operating and maintaining the Product and for facilitating your use of the Product and availing the Services.

Company or any third parties authorised by the Company, may retain Information, for such length of time as may be required, in order for the Company to provide you with Services, comply with legal obligations, resolve any disputes that may arise, enforce its rights arising out of agreements with users, and/or for such period as may be required by legislations/orders of regulatory authorities to which Company or such third party is subject to.

You may change, alter or otherwise modify or update your Information including the details you provide for creating the Account, at any time by contacting us at support@krishitantra.com.

Do note however, the Company reserves the rights to save any Non Personal Information and usage information and you are not entitled to seek the deletion of the same.

The Company at its sole discretion may permit or deny the change of any Information, if it is believed the same is required to observe applicable laws.

The Information that you provide, subject to disclosure in accordance with this Privacy Policy and Terms, shall be maintained in a safe and secure manner. Information collected by the Company or by third parties authorised by the Company are stored on secure servers with appropriate firewalls that are either owned by Company or by third parties.

While Company will use all reasonable efforts to ensure that your Information is safe and secure, it offers no representation, warranties or other assurances that the security measures are adequate, safe, fool proof or impenetrable.

If you wish to place a complaint with regard to privacy requirements or laws, access any of your Information or would like to update or correct any errors in your Information, please contact our Data Protection Officer/Grievance Redressal Officer, at complaints@krishitantra.com so that we can consider and respond to your request.

The Application is only intended for those who are the age of eighteen (18) years or older. If you are not of the requisite age, you are not obligated to provide any Information. Company reserves the right to revoke your access to use the Application and avail Services without prior notice.

This Privacy Policy is subject to change at Company’s sole discretion. Any changes to the Privacy Policy will be posted on complaints@krishitantra.com or notified to you by Company through the Application or otherwise. You are advised to review this Privacy Policy periodically for any changes.

This Privacy Policy shall form a part of the Terms of Use.
